Details were sketchy, but it sounded like a couple of them got prosecuted, although it's unclear if it was successful or not. I'm too lazy at the moment to dig into it...but here is my point. There's a saying "Don't make a Federal case out of it" that I am beginning to think applies to this approach to sexual assault on campuses. Highlight the problems, ensure that local authorities are doing their jobs, but don't force solutions through Title IX. Update....the prosecution was unsuccessful, but the players were punished anyway, and the admin will not give details on why. It could be that some players lied, etc, but they should come forward with that. If due process exonerated the players, should the university punish them? And if so, under what conditions? If I were the university, I would establish standards of behavior to cover such situations...such as, no you didn't get convicted, but you admit to being underage and drinking. Or...you admit to being intoxicated and we have a policy against being drunk and making the university look bad. And then sanction that behavior. But punishing someone that has been exonerated in open court is an invitation to some serious lawsuits, IMO. |
