If he had a witness I don't understand how they reached the decision to indict???

The charge is aggravated assault. That's pretty high up the hierarchy of violent crimes. I remember hearing that he chased after the guy. If true, that's not self defense, or defending your home. I have no idea what happened though.

I just read a little on aggravated assault. The judge has the discretion to place him on probation if convicted. I'd say there is a good chance he won't go to jail if convicted.
